Terms of Service
Terms of Service
Effective Date: [Month Day, Year]
Last Updated: [Month Day, Year]
These Terms of Service ("Terms") govern your access to and use of MacroIndex (the "Service"), including our website, web application, and any related features (including OCR scanning and AI-powered nutrition lookup). The Service is operated by [Legal Company Name] ("MacroIndex," "we," "us," or "our").
BY ACCESSING OR USING THE SERVICE, YOU AGREE TO THESE TERMS. If you do not agree, do not use the Service.
1) Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian.
2) The Service Is Not Medical Advice
MacroIndex provides nutrition and wellness tracking tools for informational and educational purposes only. - We are not a medical provider. - The Service does not provide medical advice, diagnosis, or treatment. - Do not rely on the Service for medical decisions. Consult a qualified physician or registered dietitian for medical or dietary guidance.
If you are struggling with food, body image, or self-harm, please seek support. In the United States you can call or text 988 (Suicide & Crisis Lifeline) or contact the NEDA Helpline at 1-800-931-2237.
3) Accounts and Security
You are responsible for: - maintaining the confidentiality of your login credentials, - all activity occurring under your account, - providing accurate account information.
We may disable accounts that appear compromised or used abusively. You may not create a new account to circumvent a suspension.
4) User Content and Inputs
The Service allows you to submit content including food entries, logs, goals, supplement tracking, weight and water entries, images for OCR scanning, and text prompts for AI features ("User Content").
You retain ownership of your User Content. You grant us a limited license to host, process, transmit, and display your User Content solely to operate and improve the Service and to comply with law.
5) OCR Scanning
If you upload images (for example, nutrition labels), we process them to extract nutrition values. - OCR may be inaccurate due to lighting, angle, label formatting, or other factors. - You are responsible for reviewing and confirming extracted values before saving or relying on them. - Uploaded images may be screened automatically for prohibited content before processing.
6) AI-Powered Nutrition Lookup
Some features use artificial intelligence to interpret requests and return nutrition information. - AI outputs may be inaccurate, incomplete, or outdated. - You should verify nutrition details against product packaging and official sources. - We may label results as "verified," "verified with assumptions," or "unverified/estimated," but those labels are not guarantees. - AI features are intended only for nutrition and food logging. Requests outside that scope may be refused. - Text you submit is screened by an automated content-safety service before it is processed.
7) Acceptable Use Policy
This Section applies to everything you submit to the Service, including AI requests, voice input, uploaded images, food and meal names, and feedback.
A) Prohibited content and conduct
You may not use the Service to submit, request, generate, or attempt to generate: - content that sexually exploits or endangers minors, - instructions or assistance for violent wrongdoing, weapons, or terrorism, - credible threats of violence against any person or group, - content that harasses, defames, or incites hatred against a person or group, - sexual content, or gratuitously violent or graphic content, - content that facilitates unlawful activity of any kind.
You also may not: - misuse the Service or attempt to gain unauthorized access to it, - interfere with or circumvent security features, rate limits, or usage allowances, - reverse engineer, scrape, or resell the Service, - use the Service or its AI features for purposes unrelated to nutrition and food logging, - use automated means to place load on the Service beyond normal personal use, - create a new account to evade a suspension.
B) Automated enforcement
We use automated content-safety screening. Requests that are flagged are blocked and recorded. By using the Service you acknowledge and agree that:
- Standard violations follow a warning system. Your first two flagged violations block the request and serve as warnings. A third violation results in automatic and permanent suspension of your account. These counts are cumulative for the life of the account and do not reset daily.
- Severe violations result in immediate permanent suspension on the first occurrence, without warning. This applies to content involving the sexual exploitation of minors, instructions for violent wrongdoing, and credible threats of violence.
- Suspension is permanent unless we choose to reverse it after review. Suspended accounts cannot sign in, and active sessions are ended.
- We record enforcement data, including the IP address and browser user agent associated with a suspension, as described in our Privacy Policy.
- We do not refund subscription fees for accounts suspended for violating this Section.
- We may report unlawful content to law enforcement, and we are required by law to report apparent child sexual abuse material to the appropriate authorities.
C) Self-harm is handled as a support matter, not a violation
Requests flagged as relating to self-harm or disordered eating are blocked and answered with support resources. They are not treated as violations, are not counted toward suspension, and will not result in a ban.
8) Usage Limits and Fair Use
AI lookups and label scans consume paid third-party services, so they are subject to daily allowances that depend on your plan. Manual logging, food and meal management, and progress views are not limited in this way.
We may change allowances, and may temporarily reduce or disable AI or scanning features to protect the Service, manage cost, or respond to abuse. Repeated nutrition lookups that we can serve from cache do not consume your allowance.
9) Subscriptions, Billing, and Cancellation
Some features may require a paid subscription.
- Plans and pricing are as displayed in the Service at the time you subscribe.
- Billing and renewal: paid plans are billed in advance on a recurring basis (for example, monthly or annually) and renew automatically until cancelled.
- Payment processing: payments are handled by our third-party payment processor. We do not receive or store your full card details.
- Cancellation: you may cancel at any time through the billing portal linked from your Profile. Cancellation stops future charges; your paid features remain available until the end of the period you have already paid for, after which the account returns to the free plan.
- Refunds: except where required by law, payments are non-refundable, including for partial periods and for accounts suspended under Section 7.
- Price changes: we may change prices with notice. Changes apply to renewals after the notice period.
- Taxes: prices exclude taxes unless stated otherwise; you are responsible for applicable taxes.
- Complimentary access: we may grant free access to a paid plan at our discretion, and may withdraw it at any time.
10) Admin and API Access
If you are an administrator, you may have access to administrative tooling and API endpoints. You are responsible for safeguarding API keys and ensuring you only use them in compliance with these Terms and applicable law. API keys grant broad access to data in your deployment; treat them as credentials.
11) Termination
You may stop using the Service at any time and may delete your account and data from your Profile page. We may suspend or terminate your access if we reasonably believe you violated these Terms (including Section 7), used the Service abusively, or if required to comply with law.
12) Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT NUTRITION INFORMATION WILL BE ACCURATE.
13) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MACROINDEX WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF: - THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR - $100 USD.
14) Indemnification
You agree to indemnify and hold MacroIndex harmless from claims, damages, liabilities, and expenses (including attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.
15) Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide notice by updating the "Last Updated" date and/or providing additional notice within the Service. Continued use after changes take effect constitutes acceptance.
16) Governing Law
These Terms are governed by the laws of [State, USA], excluding conflict of law rules.
